blipcare – Privacy Policy

blipcare is concerned about privacy issues and wants you to be familiar with how we collect, use and disclose information. This Privacy Policy describes our practices in connection with information that we collect through software applications (including mobile applications) and web portal (including the website currently located at http://www.blipcare.com/) that we operate and that contain or link to this Privacy Policy (such applications and web portal and sites, the "Applications"). By downloading, accessing or using the Applications, or providing information to us in connection with the Applications, you agree to the terms and conditions of this Privacy Policy. Access to, and use of, the Service is subject to acceptance of the Terms of Use.

This Privacy Policy does not address, and we are not responsible for, the privacy, information or other practices of any third party, including our third-party service providers (including cloud service providers), any healthcare providers. Please note that the Applications may include the ability to access and submit certain information directly to third-party services such as Microsoft HealthVault. You submit such information directly to such services; this Privacy Policy does not apply to, any information submitted by you to such services.

We may change this Privacy Policy at any time. Please take a look at the "Last Updated" legend at the top of this page to see when this Privacy Policy was last revised. Any changes to this Privacy Policy will become effective when we make the revised Privacy Policy available through the Applications. Your use of the Applications or the submission of any information in connection with the Applications following such changes means that you accept the revised Privacy Policy.

We reserve the right, at any time and from time to time, temporarily or permanently, in whole or in part, to: modify, suspend or discontinue the Applications; charge fees in connection with the use of the Applications; modify and/or waive any fees charged in connection with the Applications; and/or offer opportunities to some or all users of the Applications. You agree that neither we nor any of our affiliates shall be liable to you or to any third party for any modification, suspension or discontinuance of the Applications, in whole or in part, or of any service, content, feature or product offered through the Applications.

JURISDICTIONAL ISSUES

We control the Applications from the United States; accordingly, this Policy, and our collection, use and disclosure of your Personal Information and Protected Health Information, is governed by U.S. law, and not by the laws of any country, territory or jurisdiction other than the United States. We do not represent or warrant that the Applications, or any functionality or feature thereof are appropriate or available for use in any particular jurisdiction. Those who choose to access or use the Applications do so on their own initiative and at their own risk, and are responsible for complying with all local laws, rules and regulations. By using the Applications and submitting any Personal Information or Protected Health Information, users from outside the United States acknowledge that the Applications are subject to U.S. law and consent to the transfer of Personal Information and Protected Health Information to the United States, which may provide a different level of data security than in their country of residence, and waive any claims that may arise under their own national laws.

PERSONAL INFORMATION

"Personal Information" is information that identifies you as an individual. When the User interacts with blipcare through the Applications, blipcare may collect the following Personal Information from you:

  • Name
  • Postal Address (Optional)
  • Phone Numbers (Optional)
  • Email Address
  • Gender (Optional)
  • Date of Birth (Optional)
  • Picture (Optional)

Your Personal Information May Be Used –

  • To respond to your inquiries and fulfill your requests.
  • To send to you administrative information, including information regarding the Applications and changes to our terms, conditions and policies.
  • To provide services, which are offered as functionalities in the Applications such as – sending notifications and/or capturing surveys or other information using the regular mail, Email, Text or IVR Notifications.
  • To send to you marketing communications that we believe may be of interest to you.
  • To personalize your experience on the Applications by presenting products and offers tailored to you.
  • For our business purposes, such as quality assessment, data analysis, audits, developing new products, enhancing the Applications, improving our services and identifying usage trends.
  • As we believe to be necessary or appropriate: (a) under applicable law, including laws outside your country of residence; (b) to comply with legal process; (c) to respond to requests from public or government authorities, including public or government authorities outside your country of residence; (d) to enforce our terms and conditions; (e) to protect our operations or those of any of our affiliates; (f) to protect our rights, privacy, safety or property, or that of our affiliates, you or others.
  • Sharing with third parties at your initiative - As part of the Services offered, blipcare Applications allow optional sharing of the Personal Data with partner service providers (for e.g. Microsoft HealthVault). This sharing is exclusively at the User's initiative and involves the Users agreeing to let the third-party provider access his/her Personal Data. Use of the Personal Data by the third-party is entirely the responsibility of the third-party and the User. blipcare declines any liability for the same.

PROTECTED HEALTH INFORMATION

"Protected Health Information" is the combination of Personal Information with information related to physical health conditions. The blipcare Applications is a self-monitoring Healthcare tool, which allows you to capture/enter your Protected Health Information in connection with the Applications.

Your Protected Health Information May Be Used –

  • To respond to your inquiries and fulfill your requests.
  • To send to you administrative information, including information regarding the Applications and changes to our terms, conditions and policies.
  • To provide services, which are offered as functionalities in the Applications such as – sending notifications and/or capturing surveys or other information using the regular mail, Email, Text or IVR Notifications.

OTHER INFORMATION (NON-PERSONAL)

For statistical purposes, blipcare may gather browsing information, in particular via the use of cookies. Acceptance of these cookies may be required in order to create an Account. The blipcare also reserves the right to collect certain information associated with the visitor's computer (IP, access provider, hardware configuration, software configuration, country of origin), or associated with the Service (log and history of all data exchanges, log and history of connections). It is important to note that no Personal Data are collected or used during this phase.

The blipcare and it’s third-party service providers and may collect Non-Personal Information in a variety of ways, including:

  • Your Device
  • Server log files
  • Cookies
  • Physical location of your device
  • From you
  • Aggregating

Because Non-Personal Information does not personally identify you, we may use and disclose Non-Personal Information for any purpose. In some instances, we may combine Non-Personal Information with Personal Information or Protected Health Information (such as combining your zip code with your name, or with your name together with a medical condition). If we combine any Non-Personal Information with Personal Information or Protected Health Information, the combined information will be treated by us as Personal Information or Protected Health Information, as applicable, as long as it is so combined.

EXCLUSIONS OF WARRANTIES

blipcare AND ITS AFFILIATES DISCLAIM ALL EXPRESS WARRANTIES, IMPLIED WARRANTIES, INCLUDING IMPLIED WARRANTIES OF ACCURACY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. blipcare AND ITS AFFILIATES WILL NOT BE RESPONSIBLE OR LIABLE FOR ANY ERROR, DELAY OR INTERRUPTION IN THE APPLICATIONS. blipcare AND ITS AFFILIATES MAKE NO GUARANTEE, REPRESENTATION OR WARRANTY REGARDING THE TIMELINESS, RELIABILITY, ACCURACY, COMPLETENESS OR USEFULNESS OF ANY PORTION OF THE APPLICATIONS, INCLUDING THE CONTENT CONTAINED ON THE APPLICATIONS, OR REGARDING THE AVAILABILITY OR APPROPRIATENESS OF Third-Party PROVIDERS. YOU AGREE THAT YOUR ACCESS TO AND USE OF THE APPLICATIONS IS AT YOUR OWN RISK AND THAT YOU ARE SOLELY RESPONSIBLE FOR ANY LIABILITY OR DAMAGE THAT YOU MAY INCUR THROUGH USE OF THE APPLICATIONS, EXCEPT TO THE EXTENT THAT THE APPLICABLE LAWS OF A PARTICULAR JURISDICTION CANNOT BE WAIVED OR EXCLUDED BY AGREEMENT.

By using the Applications you agree that the laws of the state of Illinois, without regard to principles of conflict of laws, will govern these Conditions of Use and any dispute of any sort that might arise between you and blipcare or its affiliates.

THIRD PARTIES

This Privacy Policy does not address, and we are not responsible for, the privacy, information or other practices of any third parties, including our third-party service providers (including cloud service providers), any healthcare providers and, if applicable, mobile device and OS provider, and any other third party operating any software application or website to which the Applications contain a link. The inclusion of a link on the Applications does not imply endorsement of the linked software application or website by us or by our affiliates.

SECURITY

We seek to use within blipcare, reasonable physical, technical and administrative measures to protect Personal Information and Protected Health Information under our control. The Applications use standard secured socket layer to transmit data over the Internet. But, unfortunately, no data transmission over the Internet or data storage system is guaranteed to be 100% secure. Please also be aware that we may use third-party cloud service providers that provide hosting, data storage and other services pursuant to standard terms and conditions that are generally non-negotiable; accordingly, although we seek to conduct reasonable due diligence on such service providers, we may be unable to impose contractual obligations on them with respect to the measures they use to protect Personal Information and Protected Health Information.

If you have reason to believe that your interaction with us is no longer secure (for example, if you feel that the security of any account you might have with us has been compromised), please immediately notify us of the problem by contacting us in accordance with the "Contacting Us" section below.

ACCESS

You can access your Personal and Protected Health Information by logging into your account with in the Applications. You can access data of all the dependent users associated with your account with in the Application. You cannot access data of any independent user account unless they opt to share their data with you.

USE OF APPLICATIONS BY MINORS

The Applications are not directed to individuals under the age of thirteen (13), and we request that such individuals do not provide Personal Information through the Applications.

RETENTION

You can review and delete your data at any time. Furthermore, if you choose to delete your account from the Blipcare app, it will result in the corresponding data being removed from the Blipcare App.
